Our business specializes in the production and sale of specialty ingredients and raw materials for pastry and bakery use. Through this website www.eska.it, artisan entrepreneurs – the end users of our products (bakeries, pastry shops, and similar businesses, hereinafter referred to as "RETAIL") – may purchase directly according to the terms described below. 

GENERAL TERMS AND CONDITIONS OF RETAIL SALE

The ESKA.IT website is freely accessible without registration, but purchasing products from www.eska.it is only allowed for RETAIL businesses (and in any case holders of a valid VAT number) and for selected products clearly indicated on each product page. 

Once an order is placed, our offices will verify the professional operator status. If this cannot be confirmed, the order will be cancelled, and any amount paid will be refunded minus banking fees incurred. 

Sales to (pastry and bakery) laboratories and to local wholesalers are also possible, but registration is required, with additional conditions set out in the section “GENERAL TERMS AND CONDITIONS FOR SALES TO LABORATORIES AND WHOLESALERS”. During registration, you are required to specify whether you are classified as an artisan, bakery/pastry lab, or wholesaler. Our staff will verify that the selected customer type is accurate, as it cannot be modified by the customer after registration.

At the moment, sales are only available for the following countries:

• Austria,
• Belgium,
• Germany,
• France,
• Spain.

All product prices listed on the website are VAT excluded. We remind you that VAT is not applicable for export.

Prices may be subject to change without notice due to fluctuations in raw material costs, production costs, or organizational expenses. Prices are guaranteed for orders placed before such changes or as shown on the website at the time of purchase.

SHIPPING AND RETAIL SALE COSTS

A minimum order of €200 is required, which can include multiple products.

Registered customers are entitled to a 10% quantity discount on orders over €400 (taxable amount). A 15% quantity discount is applied to orders over €600 (taxable amount). The discount will be applied automatically in the cart once these thresholds are exceeded.

Shipping fees are applied according to country and quantity. 

Delivery times may vary from 5 to 14 working days, calculated from the date of payment receipt. Deliveries are made on working days from Monday to Friday, between 8:30 AM and 7:00 PM. If the recipient is absent, a delivery notice will be left with instructions to schedule a new delivery. Deliveries are made to street level only (no upstairs or warehouse delivery).

Upon delivery, it is the customer's responsibility to inspect the goods and report any complaints directly to the courier by noting a detailed written reservation on the courier’s delivery receipt.

REWARD POINTS FOR ONLINE RETAIL SALES

Registered customers classified as RETAIL CUSTOMERS (bakeries and pastry shop) can earn reward points that can be used as a discount on future orders. For every 10 euros of taxable purchase, the customer earns 10 reward points, which correspond to approximately 1 euro of discount. Since the minimum order value is 200 euros, each customer will earn at least 200 points (the exact amount depends on the total order value, but it is always roughly equal to 10% of the value of the purchased goods).

For customers registered as laboratories or wholesalers/resellers, please refer to the paragraph GENERAL TERMS AND CONDITIONS FOR SALES TO LABORATORIES AND RESELLERS.

Each product page displays the number of reward points awarded for each package purchased. The more you buy, the more reward points you earn!

Please note: only registered customers can earn points, view their points history in their account, and redeem accumulated points for a discount on their next order or any future order.

For orders placed after the first one, customers may redeem reward points on each order up to a maximum of 2,000 points (equivalent to €200). In any case, the discount amount may not exceed 50% of the taxable order value. Unused reward points may be redeemed on subsequent orders.

PAYMENT METHODS FOR RETAIL SALES

Accepted payment methods: PayPal and Bank Transfer.

PayPal is an electronic payment method available to holders of a PayPal account. It also allows payment via the most common credit cards, including prepaid and rechargeable cards: Visa, Mastercard, Diners, American Express. We do not have access to any credit card data; all payment information is transmitted securely and encrypted to the bank.

Bank transfer is an advance payment method that must be made after the order is placed. Please indicate the order number, date, and company name when making the transfer to the following bank details:

Orders will be processed only after receipt of payment. Therefore, the usual delivery time must be extended by the bank processing time. To expedite shipping, please send a copy of the bank transfer receipt via fax to 0429 601060 or via email to amministrazione@eska.it.

DATA PRIVACY FOR RETAIL CUSTOMERS

Before completing a purchase, you will be required to provide data necessary for order processing and delivery.

These data are processed in accordance with the "Personal Data Protection Code" (Regulation (EU) 2016/679).

Personal data are used strictly for purposes related to order management (delivery, internal statistics, etc.) and for obligations under applicable laws.

The data subject is entitled to exercise the rights provided by Privacy Law, including confirmation of data existence, knowledge of origin and processing logic, updating, correction, deletion, or blocking of data in case of unlawful processing. Requests for data deletion must be sent in writing to the company’s registered office.

RETURN POLICY FOR RETAIL SALES

Online product sales are governed by Regulation (EU) 2011/83 regarding distance contracts, applicable only to individual consumers.

Nevertheless, ESKA S.n.c. grants the right of return to all buyers. This right can be exercised within 14 days from the delivery date by sending written notice to our offices. We will arrange for the return, refund, or replacement. Return shipping costs are covered by ESKA S.n.c. only if the goods are damaged or defective. In all other cases, return costs are borne by the buyer. Notifications may be sent via email to amministrazione@eska.it or by fax to 0429 601060, preferably stating the reason.

The product and its original packaging must be intact in order to exercise the right of return.

Upon receipt of the returned goods and within 14 days, we will issue a refund unless a product exchange has been previously agreed.

GENERAL TERMS AND CONDITIONS FOR SALES TO LABORATORIES AND RESELLERS

Sales to pastry and bakery laboratories and to wholesalers in the sector are only possible after registration and approval of the data by ESKA S.n.c.

In addition to the conditions applicable to retail sales, additional discounts are provided, which are highlighted, after registration and once logged in, on the cart page under the paragraph "Attention".

Sales to customers registered as a "laboratory" entitle them to collect REWARD POINTS, similarly to what is provided for retail sales. Only the calculation method changes: for every 10 Euro of taxable amount spent, the customer earns 5 reward points, which can be used as a discount on the next order or accumulated and used as a discount on subsequent orders. 20 reward points correspond to approximately 1 Euro discount. Since the minimum order is at least €200 of goods, the customer will accumulate at least 100 reward points (the actual number of points will depend on the total amount of the order and will in any case always be approximately equal to 5% of the value of the goods purchased).

As with "retail customers", for orders placed after the first one, "laboratory" may redeem reward points on each order up to a maximum of 2,000 points (equivalent to €200).
In any case, the discount amount may not exceed 50% of the taxable order value. Unused reward points may be redeemed on subsequent orders.

On each product page, "laboratory" can see the reward points awarded for each package. The more you buy, the more reward points you earn!

Sales to customers registered as “wholesalers” do not qualify for REWARD POINTS; therefore, reward points are not displayed on product pages for these customers.

Returns are only and exclusively accepted for goods shipped that do not comply with the order, or for goods or parcels that are damaged in such a way as to reasonably suggest that they should not be used for production or human consumption.

LEGAL JURISDICTION

Pursuant to Italian Law No. 50 of 15/01/1991, the competent court for any disputes is that of the buyer’s place of residence or domicile.

If the buyer has no residence, domicile, or address in Italy, jurisdiction falls under the court of Padua. All disputes regarding payments are subject to the jurisdiction of the court of Padua (Italy).

No part of this website may be used for commercial purposes, nor modified or incorporated into any printed or digital publication.

Any unauthorized or unlawful use will be prosecuted by ESKA S.n.c. through civil and criminal legal action.
